Terms and Conditions
Order Processing
Commissions: Upon submission request for a commissioned artwork, you will be notified of an estimated completion date before the 50% deposit is due. Please be aware that while it is highly unlikely, the completion time of commission may exceed the estimated date. I believe in a professional, well finished product and strive to deliver the highest quality possible without rushing the creative journey it takes to get there. The final 50% of the payment is due once the artwork is completed and prior to the commission being shipped out.
Original artwork: Processed within 3-7 business days once payment is received in full.
Prints: Processed within 3-7 business days once payment is received in full, however, may extend up to 14 days during high traffic times (ie: print release, holidays, etc.).
Packaging
Original pastel artwork is covered with protective glassine paper and secured with a foam board back and front piece to keep the work flat. If being shipped, artwork will then be padded with bubble wrap prior to boxing to ensure safe transit.
Payment
At this time the preferred payment methods are through paypal via alyssahooterart@gmail.com or through venmo via @Alyssa-Hooter. As I evolve my shop, I will have more payment options available. Paypal processes all of PayPal payment options.
Shipping
At this time shipping is not offered. Once offered, all orders will be shipped out of Louisiana, United States of America. You will receive tracking info upon dispatch via the email entered at checkout. Shipping costs will be automatically calculated at checkout depending on the size of the original or print, your location, and chosen delivery service.
Address & Delivery
All items will be delivered to the shipping address you provide at checkout. Please make sure to double check the delivery address you provide. If an item has been shipped to an incorrect address, once it has already been sent out I will not be able to alter it to the correct address or cancel the delivery.
Please contact me immediately at alyssahooterart@gmail.com if items have arrived damaged or if you have not received it within 2 weeks after the estimated delivery date.
Returns & Refunds
In the unfortunate and highly unlikely case of a damaged product upon delivery, please contact me immediately at alyssahooterart@gmail.com to see what resolutions can be made.
Once the first deposit has been made, if the payor changes their mind they can request a refund only if the project has NOT been started on. If it has been started on, a refund will not be issued. For extenuating circumstances, please contact alyssahooterart@gmail.com.
The second and final payment is to be paid upon completion of the commission once the customer is satisfied with the product. The commission will not be shipped until the full payment has been received, including shipping costs.
Commissioned artworks are not eligible for refunds or returns.
For originals (non-commissioned artwork) and prints, if you are not satisfied with your purchase, a full refund (not including shipping costs) will be available if notified within 14 days since delivery. The refund will be granted once the item has been received by the company and in a 100% undamaged condition within 30 days of the return request. It is the buyer's responsibility to safely re-package the product the same way it was received for a damage-free return transit. To facilitate this, it is important that you keep all shipping materials in good condition until you are 100% satisfied with your purchase. The cost of a return shipment is at the buyer's expense. It is also the buyer's responsibility to choose a suitable delivery service that insures them for the value of the products should it get lost.
Buyers are responsible for tracking their delivery via the provided tracking information. If a product reaches its destination but is not received or becomes lost after an attempted delivery, it is the buyers responsibility to directly contact the shipping company for resolution or delivery. A refund (exclusion shipping costs) can only be issued if the artwork is successfully returned to the company undamaged within 30 days of initial delivery attempt as stated above.
If a original artwork or print fails to reach its destination due to being lost by the shipping company, a full refund will happily be provided or replacement when notified within 90 days since dispatch. Please make sure to track your package and inform me promptly if there are any issues. In the event of a package being returned due to an incorrect shipping address provided at checkout, the artwork will be resent with the buyer covering the cost of re-shipment.
Liabilities
For purchases outside of the USA, any additional custom and tax fees that may occur when the package reaches your country are the responsibility of the buyer. These charges may vary depending on where you are located.
Prices
I reserve the right to determine the prices for any of my art products. Product prices and shipping costs are subject to change at any time. If you have already placed your deposit for commission, an increase or decrease in price will not effect your original cost.
Product accuracy
As a result of having different technology devices with different screens, the colors may vary depending on what device it is viewed. Replica prints that accompany commissioned artworks may have a slightly difference appearance compared to the original artwork, everything possible is done to minimize this and make the prints as similar as possible.
For pastel works that have a color background, portraits come with a border that is about a 1/4 inch thick that is colored the color of the original Clairfontaine pastelmat paper. This makes it possible to pick up the drawing without disturbing/touching any of the artwork. Please keep in mind that this color can vary depending on the color of the pastelmat used and will slightly reduce the side of the portrait when framing. Professional framers usually factor this in.
Due to the nature of the soft pastel medium, there can be slight blemishes on the paper. Please know that all measures are taken to prevent this from happening or minimize the appearance of it. Actual paper sizes may vary slightly due to varying measuring devices.
Changes to completed commissions
Once final touches are completed on a commission, multiple high quality photos and possibly videos will be provided to confirm the payor's satisfaction. If you wish to have minor adjustments made (fur length, extra shine on face features, etc.) this can happen. However, if a change is too big that it cannot be done nicely without substantial upset to the completed portion due to the nature of the soft pastel material, large changes may not be able to be made.
Framing
All artwork arrives unframed, protected by glassine paper and foamboard mounts.
Social media
All commissions are warranted to being on video, photographed, or otherwise displayed on the alyssahooterart social media pages including instagram and website. If you wish for your piece to not be displayed until after it has been received or gifted, please let me know in your submission order. Every commission once gifted to its owner, will be posted on the social media and website.
Copyright Information
Alyssa Hooter Art retains the copyright for all commission artwork. Alyssa Hooter Art also retained the copyright for any prints of commissioned artworks. No commission artworks may be reproduced, altered, or copied by anyone other than Alyssa Hooter Art. However, if not requested by the buyer, Alyssa Hooter Art will NOT produce prints of any commissioned piece for individual sale. Alyssa Hooter Art reserves the right to share commissioned artworks for self promotional purposes.
The copyright for any non-commissioned artworks remain with Alyssa Hooter Art and I alone reserve the right to reproduce those images. Alyssa Hooter Art reserves the right to use artwork for promotional purposes and in other promotional areas.
Final provisions
By ordering any product, you agree to be bound by these terms & conditions.
By placing an order, you agree that you are at least 18 years old or have parents' permission.
Shipping costs and payment fees are recognized before purchase.
All custom fees and taxes are a responsibility of the customer.
Commissions may be recorded, documented, or posted on our website & social media sites.
These terms and conditions are subject to change at any time without notice.
Privacy Policy
Your privacy is of the upmost importance to us. We do not share any data with third party individuals or companies. Alyssa Hooter Art is the sole owner of the information collected on this site. We only have access to/collect information that is voluntarily given via email or any other direct contact from you. This information will not be sold or rented to anyone.
By using Alyssa Hooter Art website, you consent to the data practices desribed in this statement.
In order to provide notice of products and services offered, Alyssa Hooter may collect personally identifiable information such as first and last name, mailing address, e-mail address, and phone number. When you purchase an Alyssa Hooter product or service, billing and credit card information may be collected. This information is used to complete the transaction but is held in an encrypted and secure payment processing service (paypal or venmo). Alyssa Hooter has no access to this information.
Personal information about you is not collected unless voluntarily provided to us. Certain information may be required to be provided if certain products are purchased on the website. This may include signing up for newsletter, submitting a commission request form, entering a sweepstakes or contest sponsored by us, sending us an email message, or submitting your credit card or payment information when ordering and purchasing products and services on our site. Your information is used to communicate with you in relation to services and/or products you have requested from us. We may also gather additional person or non-personal information in the future.
Your information is collected and used to create and deliver products or services you have collected. Alyssa Hooter may also use your personally identifiable information to inform you of other products or services available from Alyssa Hooter Art.
